Valid Grounds for Divorce in New York State
New York State traditionally has one of the lowest divorce rates in the country – only 2.9 divorces per 1,000 residents. Family law courts grant divorces if the spouse filing for divorce provides one of seven available reasons, called legal grounds.
The state code allows to choose from both no-fault and fault-based grounds:
1. Irretrievable breakdown of the marriage that occurred for six months before filing;
2. Cruel treatment that poses a danger to the physical and mental health of the spouse and family members;
3. Adultery (the filing spouse would need to prove this fact with proper evidence);
4. Imprisonment for more than three years;
5. Abandonment for one year or more;
6. Divorce with a separation agreement after separate living for at least one year;
7. Living apart for one year after a Judgement of separation was issued.
